DMCA (Digital Millennium Copyright Act)
In 1998, the DMCA (Digital Millennium Copyright Act) was passed by the U.S. Congress to tackle the issue of copyright infringement in the digital realm. If a copyright holder or their authorized agents believe their rights have been infringed upon, they can send a DMCA Notice to our appointed Copyright Agent. Newzbee is 100% compliant with the DMCA's established procedures.
Filing DMCA Notices
Only copyright holders or their agents are eligible to file DMCA notices. Responses will be issued exclusively to those who own the copyright and have filed a DMCA Notice.
Requirements for a valid DMCA-Notice
A DMCA Notice must adhere to the DMCA's specified standards and requirements. Key components of a valid DMCA Notice include:
- Detailed description of the copyrighted work that is claimed to be infringed, or, in the case of multiple works, a comprehensive list of these works.
- Precise identification of the content alleged to be infringing, along with sufficient details for Newzbee to find it, such as topic, date, time, message-ID(s), and the newsgroup in which it appeared.
- Full contact information of the complainant, including name, address, telephone number, email address, and if an agent is involved, a statement clarifying their relationship with the copyright holder.
- A statement by the complainant, based on a good faith belief, that the disputed use of the material is not authorized by the copyright owner, their agent, or the law.
- A sworn declaration, under penalty of perjury, attesting to the truthfulness of the information in the DMCA Notice and the authority of the person submitting it to act on behalf of the copyright holder. This includes the physical or electronic signature of the authorized person.
DMCA Notices should be sent to our designated Copyright Agent. Please note, if your notice does not meet the necessary criteria, we may not be able to process or respond to it.
Upon Receipt of a Valid Notice
Upon receipt of a legitimate Notice, Newzbee will:
- Remove or restrict access to the material alleged to be infringing.
- Notify the subscriber about the removal or restriction of the material.
